§ 61g. Charge for medical and dental services

Every physician and every dentist authorized to practice his profession in Puerto Rico, and in the private practice thereof, may charge a reasonable fee for his professional services rendered to patients in health institutions owned by the Commonwealth of Puerto Rico, its municipalities and instrumentalities, when said patients are ineligible to receive those services chargeable to the funds of the Commonwealth or the municipality. These professionals may also charge the labor organizations that avail themselves of the programs established under § 61c of this title for services rendered to said workers in such institutions. The fees for these services shall be fixed according to the regulations established for such purposes by the Secretary of Health. In fixing the reasonable fees, due consideration shall be given to the current and prevailing prices in the community and the best interests of the patients.

Services rendered to indigent patients shall be paid by the Commonwealth of Puerto Rico, its municipalities and instrumentalities. The charge for these services shall be subject to the regulations that the Secretary of Health shall establish for such purpose. The fees for these professional services shall not be higher than the reasonable charges prevailing, established under Part “B” of Title XVIII of the Social Security Act of the United States.

The physicians and dentists who belong to the medical staffs of health institutions owned by the Commonwealth, its municipalities and instrumentalities, may render such services, provided they accept the corresponding appointment, under the regulations promulgated to such effects by the Secretary of Health, which define the duties, responsibilities and rights of these professionals as members of said medical staffs, or, when they render said services to eligible patients, they do so as part of the Integral Medical System that the Department of Health shall establish pursuant to the provisions of this chapter.
