§ 457. Powers and duties of the Secretary and the Superintendent

(1) The Secretary shall have the following duties, powers, functions and obligations with regard to the sport of target shooting in Puerto Rico:

(a) Promote the development of the target shooting sport in Puerto Rico, by cooperating for this purpose with the existing gun clubs, federations and organizations, or with those that may be organized in the future, by all available means within his reach.

(b) Certify that a person is a bona fide participant of the target shooting sport so that the Superintendent can consider issuing a permit to engage in target shooting.

(c) Certify that an entity is a bona fide gun club or federation so that the Superintendent can consider issuing the corresponding permit.

(d) Organize and hold annual target shooting championships with the weapons permitted by law.

(e) Appoint the judges, dealers and field officials that will perform in them; and select and provide the trophies, medals, or diplomas that will be awarded as prizes to the winners.

(f) Declare a national champion each year, in each category, based on their points in each championship, and publish a notice of the points obtained by the first six (6) contenders in each category. The winner shall hold the title as champion in each category for the period that ends when the next championship is held. It shall not be necessary to equal or exceed the previous record to be declared a champion, and it shall suffice to establish the highest number of points among those participating.

(g) Attend or delegate on a person of his choice, all the target shooting contests that are held in Puerto Rico under the auspices of any gun club or organization, when he deems it convenient or is requested to do so by the sponsoring club.

(h) Given the nature of the tourism industry in Puerto Rico, to cooperate with gun clubs and organizations in holding international tournaments or championships.

(2) On his part, the Superintendent shall have the following duties, powers, functions and obligations with regard to the sport of target shooting in Puerto Rico:

(a) Issue target shooting permits to all persons who hold a weapons license who request it, and that comply with and meet the requirements stated in the provisions of this chapter; Provided, That the Commonwealth and municipal police and persons with physical disabilities shall be exempted from the payment of the internal revenue fees required by the law, making the corresponding annotation on the identification papers of the concessionaire and the central registry of the Police, against the weapons license of the person in question.

(b) Cancel the target shooting permits as provided in this chapter, giving due notice to the interested parties.

(c) Keep a register with the name, age, and address of every person to whom a target shooting permit has been issued, as well as the number of his/her weapons license, and the number of the federate seal of the federation to which he/she belongs; as well as informing the Secretary of the cancellations of the target shooting permits in effect for not renewing the federate seal as provided herein.

(d) Issue licenses to gun clubs that request them, upon the favorable recommendation of the Secretary.

(e) Cancel licenses issued to gun clubs as provided in this chapter, giving notice thereof to the interested parties.

(f) Keep a registry of the name, address and other data of the gun clubs that have obtained the corresponding licenses under the provisions of this chapter.

(g) Keep a register of the name, address, and license number issued to each gun club.

(h) At the request of the gun club or organization sponsoring tournaments in which participants from abroad shall participate, to expedite the issuing of temporary target shooting permits to the participants from other jurisdictions without requirements other than those set forth in § 457d of this title.
