§ 255. Penalties

(1) Any person violating §§ 242 or 254 of this title shall be guilty of a misdemeanor and shall, upon conviction thereof, be punished by a fine of not more than three thousand dollars ($3,000), or by imprisonment in jail for a term of not more than one (1) year, or by both penalties, [at] the discretion of the court, for the first offense. For a second and subsequent offenses he shall, upon conviction, be punished by imprisonment in jail for a term of not more than two (2) years.

(2) Any person deliberately making a false statement in his application for a license for the purposes of this chapter shall be guilty of a misdemeanor punishable by a fine of not more than three thousand dollars ($3,000), or imprisonment in jail for a period of not more than one year, or both penalties, [at] the discretion of the court.
