§ 8647a. Penalties for small and medium-size businesses

(1) When any business has been registered as a small or medium-size business on the basis of false information furnished by the business and the latter has participated in the procurement process, the Company, after giving notice and meeting the requirements of due process of law, shall:

(a) Fine the business for a maximum of up to ten percent (10%) of the total value of the purchase, and

(b) request that the Administration declare the business as ineligible for contracting with the Government for a minimum period of three (3) months and a maximum of twenty-four (24) months.

(2) Any small or medium-size business registered by the Company shall immediately notify the Company about any circumstance that affects its eligibility under this chapter or it shall be sanctioned by virtue of the aforementioned clauses (a) and (b) of subsection (1) of this section.
