§ 8957. Rulemaking authority

The Department of Justice, in conjunction with the Puerto Rico Police, and the Municipal Police, shall have ninety (90) days to draft, approve, and adopt the rules to establish responsibilities and actions regarding the implementation and purposes of this Act. It is further provided that said rules shall include, among others: information explaining to employees what constitutes misconduct, establish that directors and supervisors have the duty to enforce the sexual harassment policies, and the legal and/or disciplinary consequences for failing to take action regarding complaints that may have been filed; the duty of the agency to take prompt and appropriate action; specify elements constituting an offense to prevent that the wrong person becomes the victim, in the event that the other party uses this Act as a threat; the investigation protocol to be established shall apply, firstly, and provide for a preliminary administrative investigation before filing a criminal action that could affect or harm the image, professional development, and family life of someone wrongly accused.
