§ 4123. Field hands, mechanics, artisans, and other laborers—When contractor cannot demand payment

A person who has bound himself to give his labor or industry only cannot demand any payment if the work is destroyed before it is delivered, unless there should have been delay in receiving the same, or if the destruction should have been due to the bad quality of the materials, provided that he may have given due notice of this circumstance to the owner.
