§ 1301b. Conflicts

The provisions of § 1279 of this title relative to the division of common ownership and the provisions of § 1283 of this title relative to the peremptory sale of a thing under common ownership shall not apply to condo hotels regulated under this chapter. Furthermore, there shall be no right to rescind any sale or other transfer of a right regulated under this chapter. In the event that any conflict between the provisions of this chapter and the provisions of any other law or regulation arises, the provisions of this chapter shall prevail with respect to all matters addressed therein. Notwithstanding the foregoing, it is hereby provided that a condo hotel shall be deemed to be included in the term “hotel” for purposes of the application of the Innkeeper’s Act.
