Any physician who issues the certificate required by section 235-240 of this title to be presented to the registrar of vital statistics, stating that a person does not suffer from the diseases or abnormalities enumerated in § 235 of this title shall, when it is shown that at the time the medical certificate was issued the said person was disqualified to contract marriage in accordance with the provisions hereof, be guilty of a misdemeanor, and, upon conviction, shall be punished by a fine of not less than two hundred (200) nor more than five hundred (500) dollars, or by imprisonment in jail for not less than ninety (90) days nor more than six (6) months, or by both penalties, in the discretion of the court.
