§ 712b. Secretary of Justice; regulation of payment for autopsies, exhumations

(a) The Secretary of Justice is hereby empowered to fix by regulation the amount and manner of payment of medical fees, per diems and mileage, in cases where an autopsy is performed pursuant to § 12-A of Act No. 206 of May 15, 1943, as amended. The preceding provision shall not be construed as limiting or in any manner whatsoever impairing the powers granted by law to the Institute of Forensic Medicine or to the Director thereof. The regulating power of the Secretary shall be exclusively restricted to those cases where an autopsy is performed by a physician whose services have not been contracted for or are not being rendered pursuant to any of the provisions of Act No. 206 of May 15, 1943, as amended. In those cases where the physician making the autopsy is an officer or employee of, or is rendering services under contract to, the Commonwealth Government or to any of the instrumentalities or political subdivisions thereof, and is not, in anywise, rendering services under the provisions of Act No. 206 of 1943 mentioned above, the payment of medical fees, per diems and mileage shall be made without subjection to the provisions of § 551 of Title 3, provided such autopsy takes place outside of the regular hours of the physician, and the performance thereof is not included among the duties of his office, employment or functions.

(b) The regulating power of the Secretary of Justice established in the preceding subsection shall also cover those cases where the exhumation of the corpse is imperative for the purpose of performing an autopsy.

(c) The regulations referred to in this section shall be adopted and promulgated pursuant to §§ 1041—1059 of Title 3.
