§ 358. Licenses issued, not transferable

Each license shall be issued solely for the physical premises and the natural or juridical, public or private person applying for the same and it shall not be transferable, assignable or conveyed. Every duly licensed establishment shall post its license in a place clearly visible to the public.

The sale, conveyance, lease, transfer or assignment, through the payment of a price or gratuitously, of the establishment for the elderly to any natural or juridical person who does not possess a certificate of eligibility from the Department of the Family certifying that said person meets the requirements established by this chapter and its regulations for a license to operate these establishments from the Department, is hereby prohibited.

Any advertisement of sale or any other establishment transaction that directly or indirectly expresses that the transaction will include the resident elderly persons is hereby prohibited.

Any person who violates the provisions of this section will be subject to the penalties established in § 363 of this title. Every sale, conveyance, rental or transfer of an establishment in violation of this section’s provisions shall also be just cause for the cancellation of the license.
