Section 24-5-14-13 - Deceptive act of caller; remedies and penalties(a) A caller who violates this chapter commits a deceptive act that is actionable by the attorney general under IC 24-5-0.5-4 and that is subject to: (1) the remedies and penalties under IC 24-5-0.5-4(c), IC 24-5-0.5-4(d), and IC 24-5-0.5-4(f); and(2) a civil penalty of not more than the following:(A) Ten thousand dollars ($10,000) for the first violation.(B) Twenty-five thousand dollars ($25,000) for each violation after the first violation.(b) A civil penalty recovered by the attorney general under subsection (a)(2) for a violation of this chapter shall be deposited in the consumer protection division telephone solicitation fund established by IC 24-4.7-3-6 to be used for the administration and enforcement of this chapter.Amended by P.L. 242-2019,SEC. 11, eff. 7/1/2019.As added by P.L. 117-1992, SEC.2.
