Section 16-41-39.8-14 - Violation penalty; recovery and enjoinment(a) A person who violates: (1) any provision of this chapter; or(2) a rule or standard adopted by the state department under section 6 of this chapter; is liable for a civil penalty not to exceed twenty-five thousand dollars ($25,000) per day for any violation.
(b) The state department may: (1) recover the civil penalty described in subsection (a) in a civil action commenced in any court with jurisdiction; and(2) request in the action that the person be enjoined from continuing the violation.As added by P.L. 57-2009, SEC.17.
