Section 42-4-706 - Obedience to railroad signal
(1) Any driver of a motor vehicle approaching a railroad crossing sign shall slow down to a speed that is reasonable and safe for the existing conditions. If required to stop for a traffic control device, flagperson, or safety before crossing the railroad grade crossing, the driver shall stop at the marked stop line, if any. If no marked stop line exists, the driver shall:
(a) Stop not less than fifteen feet nor more than fifty feet from the nearest rail of the railroad grade crossing and shall not proceed until the railroad grade can be crossed safely; or
(b) If the driver would not have a reasonable view of approaching trains or on-track equipment when stopped in accordance with subsection (1)(a) of this section:
(I) Stop before proceeding across the railroad grade crossing at the point nearest the crossing where the driver has a reasonable view of approaching trains or on-track equipment; and
(II) Not proceed until the railroad grade can be crossed safely.
(2) No person shall drive any vehicle through, around, or under any crossing gate or barrier at a railroad crossing while such gate or barrier is closed or is being opened or closed, nor shall any pedestrian pass through, around, over, or under any crossing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being opened or closed.
(3) Any person who violates any provision of this section commits a class A traffic infraction.

(1) This section is similar to former § 42-4-606 as it existed prior to 1994, and the former § 42-4-706 was relocated to § 42-4-806 .

(2) Section 5(2) of chapter 218 (HB 21-1245), Session Laws of Colorado 2021, provides that the act changing this section applies to offenses committed on or after September 7, 2021.
