Section 45-51-120 - Participation in Employees' Retirement System; transfer of assets and liabilities

Notwithstanding the provisions of Act 833, 1969 Regular Session (Acts 1969, p. 1523), as amended by Act 356, 1973 Regular Session (Acts 1973, p. 492); Act 618, 1977 Regular Session (Acts 1977, p. 930); Act 81-724, 1981 Regular Session (Acts 1981, p. 1235); Act 85-568, 1985 Regular Session (Acts 1985, p. 867); Act 88-436, 1988 Regular Session (Acts 1988, p. 636); Act 89-469, 1989 Regular Session (Acts 1989, p. 971); Act 89-981, 1989 Special Session (Acts 1989, p. 20); Act 93-392, 1993 Regular Session (Acts 1993, p. 675); Act 94-569, 1994 Regular Session (Acts 1994, p. 1041); and Act 2002-421, 2002 Regular Session (Acts 2002, p. 1083), Montgomery County, by action of the county commission, may take any actions necessary to participate in the Employees' Retirement System of Alabama pursuant to Section 36-27-6, and the remaining provisions of Chapter 27 of Title 36, and may transfer any assets and liabilities of the Retirement System for Employees of Montgomery County, as necessary for Montgomery County to participate in the Employees' Retirement System. Upon acceptance of Montgomery County in the Employees' Retirement System of Alabama, the Montgomery County Commission shall terminate the retirement system established pursuant to Act 833, 1969 Regular Session (Acts 1969, p. 1523), as amended by Act 356, 1973 Regular Session (Acts 1973, p. 492); Act 618, 1977 Regular Session (Acts 1977, p. 930); Act 81-724, 1981 Regular Session (Acts 1981, p. 1235); Act 85-568, 1985 Regular Session (Acts 1985, p. 867); Act 88-436, 1988 Regular Session (Acts 1988, p. 636); Act 89-469, 1989 Regular Session (Acts 1989, p. 971); Act 89-981, 1989 Special Session (Acts 1989, p. 20); Act 93-392, 1993 Regular Session (Acts 1993, p. 675); Act 94-569, 1994 Regular Session (Acts 1994, p. 1041); and Act 2002-421, 2002 Regular Session (Acts 2002, p. 1083) and return all employee contributions, plus any applicable interest, to any retiree of the Employees' Retirement System of Alabama or Teachers' Retirement System of Alabama that currently participates in the Montgomery County Retirement Systems.
