Section 11-NEW - [Newly enacted section not yet numbered] [Effective 10/1/2024] Restrictions on appliances prohibited
(a) For the purposes of this section, the term "appliance" means an item used in the home for the performance of domestic chores or tasks, or used in a commercial or industrial setting for the performance of similar tasks, including, but not limited to, cooking, food storage, heating, cooling, washing, or drying, and the term "governmental entity" shall have the same meaning provided in Section 41-1-41, Code of Alabama 1975.
(b) A governmental entity may not enact or enforce any resolution, ordinance, regulation, rule, code, program, or policy, or take any other action that restricts or prohibits, or has the effect of restricting or prohibiting, any person or other entity from acquiring or using any appliance solely based on the type of energy or energy generation used to operate the appliance.
(c) Nothing in this section shall be construed to limit a governmental entity's authority to do any of the following:
(1) Regulate any entity providing energy or energy generation.
(2) Prohibit the use of any household appliance for an illegal purpose.
(3) Take actions to ensure that the usage of a household appliance complies with the manufacturer's recommendations.
(4) Exercise existing authority to review or approve applications for building permits or to otherwise enforce building, fire, or other public safety codes or other regulations.
