Section 36-566 - Request for termination from a state facility, program or serviceA. Upon written request from the responsible person for termination of the client from a developmental disabilities program or service operated directly or indirectly by the department, or when it has been determined at an evaluation that the client has the necessary independent living skills as determined by the client's individual program plan, the department shall immediately terminate the client's programs and services. This section does not conflict with section 36-560, subsection J or section 36-551.01, subsection M.B. The department shall terminate a client from developmental disabilities programs and services operated by or supported by the department at the age of eighteen years unless the responsible person has filed a written application for the continuation of services or programs.C. Six months prior to the eighteenth birthday of a client, the department shall give written and oral notice, subject to the language and communication requirements of section 36-551.01, subsection P, to the client and the responsible person. This notice shall state that the department is required to terminate the client from developmental disabilities programs and services operated by or supported by the department at the age of eighteen years unless the responsible person has filed a written application for the continuation of services or programs and that a guardian may be required for the client pursuant to section 36-560, subsection E.
