Section 26.05.450 - Who may convene a general court-martial(a) A general court-martial may be convened by (2) the adjutant general;(3) the commanding officer of a force of the militia of the state;(4) the commanding officer of a division or a separate brigade;(5) the commanding officer of a separate wing.(b) If a commanding officer who is authorized to convene a general court-martial is the accuser in a matter, the court hearing the matter shall be convened by superior competent authority.(c) A superior authority may convene a case if the superior authority considers it desirable.Added by SLA 2016, ch. 55,sec. 4, eff. 7/1/2016.This section was originally numbered as 26.05.446 but was changed by the revisor of statutes.
