Rule 3A:5 - The Grand Jury(a)Who May Be Present. Only the grand jurors and the witness under examination and, if directed by the court, an interpreter may be present during the hearing of evidence by a grand jury. Only the grand jurors may be present during their deliberations and voting.(b)Secrecy. No obligation of secrecy may be imposed upon any person except in accordance with law.(c)Finding and Return of Indictment. The indictment must be endorsed "A True Bill" or "Not a True Bill" and signed by the foreman. The indictment must be returned by the grand jury in open court.(d)Motion to Dismiss. A motion to dismiss the indictment may be based on constitutional objections to the array or on the lack of legal qualification of an individual juror.Amended by order dated September 3, 2020, effective 9/3/2020; amended by order dated November 23, 2020, effective 3/1/2021.
