Section 3 - Notification of the public defender or assignment of counsel

In all cases where the right of a needy person to be represented by counsel exists, and is not waived, the court shall notify the public defender. The court shall assign counsel if:

(a) the public defender is unable, due to a conflict of interest or otherwise, to represent the person in question;
(b) the court determines the case is appropriate for co-counsel or associate counsel in addition to the public defender; or
(c) the court, for good cause, determines the need for a replacement attorney in lieu of the public defender.

If the Defender General has entered into a contract with an attorney or law firm to provide assigned counsel services, the court shall assign that attorney or firm unless the court determines that one of the above exceptions continues to apply, in which case the court shall assign alternate counsel.
