Rule *1905C - Notification Of Victim Upon Release Of Offender(a)The Dauphin County Victim/Witness Assistance Program shall be included on the distribution of any order sentencing a defendant to a term of incarceration imposed pursuant to the Protection from Abuse Act, 23 Pa.C.S. § 6101 et seq.(b)(1) The Warden of Dauphin County Prison shall notify Victim/Witness of the impending release of an offender from any incarceration imposed. Notification shall be made by telephone and facsimile transmission of the release form which shall include the date and time of release as well as the terms and conditions imposed. If the offender is to be released after normal business hours, on a holiday, or during the weekend, the Warden shall notify Victim/Witness by noon on the last business day preceding the date of release.(2) Victim/Witness shall immediately advise the victim of the offender's impending release.(c) Notification shall be required for work release, furlough, medical leave, community service, discharge, escape and recapture.(d)(1) The Dauphin County District Attorney's Office shall provide Victim/Witness with the present address and the telephone number of the victim immediately after a defendant has been sentenced to a term of incarceration. Victim/Witness shall contact the victim to advise him/her of the notification procedure and shall procure from the victim additional contact information, including alternative contact points.(2) If a private criminal complaint has been filed, it shall be the responsibility of the victim to notify Victim/Witness of his/her current address.(3) It is the responsibility of the victim to advise the District Attorney's Office of any change in contact information. Failure to do so shall constitute waiver of any right to notification under this section.
