Rule 202 - Judicial Notice of Law(a) When Discretionary. A court may take judicial notice on its own of the following: (1) the common law, constitutions, and public statutes in force in every state, territory, and jurisdiction of the United States;(2) private acts and resolutions of the United States Congress and the Michigan Legislature;(3) ordinances and regulations of Michigan governmental subdivisions or agencies; and(4) the laws of foreign countries.(b) When Conditionally Mandatory. A court must take judicial notice of each matter in subrule (a) if a party so requests and:(1) supplies the court with sufficient information to enable it to properly comply with the request; and(2) gives each adverse party such notice as the court may require to enable the adverse party to meet the request.Amended September 20, 2023, effective 1/1/2024.
