Rule 35 - Compensation of Private Attorneys

Pursuant to Rule 6.7, Arizona Rules of Criminal Procedure, the Superior Court in Gila County herein sets forth the manner in which private attorneys appointed to provide trial and appeal services to indigent defendants shall be compensated.

Gila County contracts with private counsel for indigent defense services, both trial and appellate. Contracts are annual contracts, with automatic renewal options, based upon public requests for proposals. Responses to requests for proposals are submitted to the judges of the court, who review the qualifications of the submitters and who interview prospective selectees. Selection from among persons who have submitted proposals is made by the Presiding Judge. Funding is primarily from the general fund of Gila County; monthly disbursements are made after review and approval by the court administrator.

Cases, trial and appellate, are assigned to counsel who have been awarded contracts based upon a blend of criteria, including workload, geographic and case type considerations.
