Rule 6 - The General Counsel
(a)Duties and functions. The general counsel for the Alabama state bar shall exercise and perform all of the duties, functions, and powers conferred upon him or her by these rules, including, but not limited to:
(1) Performing all prosecutorial functions, consisting of screening all information relating to alleged lawyer misconduct or incapacity that comes to his or her attention to determine whether the alleged misconduct is within the jurisdiction of the disciplinary commission and the disciplinary board;
(2) Investigating all allegations which, if true, would constitute grounds for discipline or transfer to disability inactive status;
(3) Recommending disposition based upon the facts revealed by the investigation;
(4) Prosecuting matters at all stages; and
(5) Any other duty or responsibility conferred upon him or her by the executive committee of the board of commissioners of the Alabama state bar.
(b)Staff. The general counsel, with the approval of the executive committee of the board of commissioners of the Alabama state bar, shall appoint and supervise the members of his or her staff. References to the general counsel shall be deemed to include the assistants to the general counsel of the Alabama state bar.
(c) Personnel Decisions Concerning the General Counsel. The Board of Bar Commissioners' decisions concerning the appointment of the General Counsel, the General Counsel's compensation, and the termination of the General Counsel's employment shall be subject to the approval of the Supreme Court of Alabama.
