Section 5-474 - Date of TestAll seed sold, offered or exposed for sale in this State shall show on the label the month and year in which the germination test was completed.
(1) No more than nine calendar months for agricultural seed, except cool season grasses, shall have elapsed between the last day of the month in which the germination test was completed and date of sale or exposure for sale of seed.(2) No more than fifteen calendar months for cool season grasses, Kentucky Bluegrass, Red Fescue, Chewing Fescue, Hard Fescue, Tall Fescue, Perennial Ryegrass, Intermediate Ryegrass, Annual Ryegrass, Colonial Bentgrass, Creeping Bentgrass and mixtures thereof, shall have elapsed between the last day of the month in which the germination test was completed and date of sale or exposure for sale of seed.(3) No more than twelve calendar months for vegetable seed shall have elapsed between the last day of the month in which the germination test was completed and date of sale or exposure for sale of seed.(4) No more than twelve calendar months for flower seed shall have elapsed between the last day of the month in which the germination test was completed and date of sale or exposure for sale of seed.(5) Hermetically sealed seed as defined in Section 46-21-211.Amended by State Register Volume 34, Issue No. 5, eff May 28, 2010.
