Section 3680.63 - Conflict of interest(a) The following persons may not comprise the legal entity of a private agency: (1) An employe of a public agency, or an official of a political subdivision, which purchases services from the agency.(2) Immediate family members of the persons specified in paragraph (1).(b) No government funds may be used by a private agency in a related party financial transaction without a prior written determination by the Department that the transaction is at a competitive cost or under terms more favorable to the agency.(c) In requesting a determination by the Department under subsection (b), the private agency shall do the following: (1) Clearly outline the terms of the agreement.(2) Demonstrate that the agreement is at a competitive cost or under terms more favorable to the agency.The provisions of this §3680.63 amended January 23, 1987, effective 1/24/1987, 17 Pa.B. 392.The provisions of this §3680.63 issued under Articles II, VII, IX and X of the Public Welfare Code (62 P.
