Section 551.83 - Provisional license(a) The Department may issue a provisional license if: (1) There are numerous deficiencies or a serious specific deficiency in compliance with applicable statutes, ordinances or regulations.(2) The ASF is taking appropriate steps to correct the deficiencies in accordance with a plan of correction submitted by the ASF and agreed upon by the Department.(3) There is no cyclical pattern of deficiencies over a period of 2 or more years. A cyclical pattern is one where an ASF is alternately in and out of substantial or full compliance, which is corrected only when actively supervised by the Department.(b) A provisional license is valid for a specific time period of no more than 6 months.(c) A provisional license may be renewed no more than three times.The provisions of this § 551.83 amended October 22, 1999, effective 11/22/1999, 29 Pa.B. 5583.
