Section 603-074-0016 - Complaint Evaluation(1) "Complaint" means information provided by a complainant concerning possible violations of ORS Chapter 468 or 468B or any rule, order, or permit adopted thereunder and relating to the control and prevention of water pollution from a CAFO.(2) If the Department finds, upon investigation of the complaint, that the complaint was groundless and made for the purposes of harassing the person against whom the complaint was filed, the Department may refuse to consider future complaints made by the complainant. Such a determination may include an evaluation of: (a) Relationship between the person against whom the complaint was filed and complainant;(b) Number and validity of previous complaints filed by complainant against the same person; and(c) Frequency of complaints filed by complainant against the person.Or.
