Section 581-015-2390 - Definitions for Hearings Under Section 504 of the Rehabilitation ActThe following definitions apply to OAR 581-015-2395:
(1) "Student with a disability under Section 504" means any student who has a physical or mental impairment that substantially limits one or more major life activities.(2) As used in section (1) of this rule: (a) "Physical or mental impairment" means any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the following body systems: Neurological; musculoskeletal; special sense organs; respiratory, including speech organs; cardiovascular; reproductive; digestive; genito-urinary; hemic and lymphatic; skin; endocrine; any mental or psychological disorder, such as intellectual disability, organic brain syndrome, emotional or mental illness, and specific learning disabilities;(b) "Major life activities" means functions such as caring for one's self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working;(3) "Qualified student with a disability under Section 504" means a student with a disability under Section 504 who is: (a) Of an age during which persons without a disability are provided educational services;(b) Of any age during which it is mandatory under state law to provide such services to students with disabilities; or(c) To whom a state is required to provide a free appropriate public education under the Individuals with Disabilities Education Act.(4) "School District" means a school district as defined in ORS 343.153.Or.
