Today, I signed into law Enrolled House Bill 3050. This Bill makes several amendments to state statutes regulating the transfer and sale of state owned property. In particular, one amendment requires state agencies, boards, commissions and public trusts to obtain approval from the Long Range Capital Planning Commission prior to any transfer or real property owned by the entity. Additionally, the proceeds from the sale of such real property are required to be deposited "within the Maintenance of State Buildings Revolving Fund."

On April 28, 2014, I also signed into law a companion bill, Enrolled House Bill 2831. House Bill 2831 made several amendments to the Department of Mental Health and Substance Abuse Services property trust. The amendments provided for any proceeds from the sale or transfer of real property held in the Department's Real Property Trust to be used "exclusively for the tangible infrastructure improvements that benefit the persons serviced by the Department Y"

I hereby order all state agencies to construe House Bill 2831 and House Bill 3050 together and consistent with the other giving each Bill full force and effect to both, as both House Bill 3050 and House Bill 2831instruct on how certain state entities must utilize proceeds from the sale of real property and are consistent with the other.

This Executive Order shall be distributed to the director of the Office of Management Enterprise Services, the Department of Mental Health and Substance Abuse Services, and the Long Range Planning Commission who shall cause the provisions of this Order to be implemented as herein directed.
