Section 08B .0203 - MEDICAL EXAMINATIONS OF APPLICANTS AND MEMBERS(a) As described in Regulation .0110 of Section .0100 of this Subchapter, all applicants for employment must successfully complete a physical and emotional examination carried out by the BPS Medical Services Director.(b) The director shall be responsible for supervising physical examinations of members of BPS. The director shall select internists and board-certified family physicians in appropriate locations to cooperate with him/her in making these examinations.(c) The BPS Medical Services Director and the approved physicians shall also make physical and emotional examinations of all BPS members according to the following schedule: (1) Each member who is 40 years old or less shall be examined once every four years, beginning four years after the date of the examination given during the application process.(2) Each member who is at least 41 years old, but less than 55 years old, shall be examined once every two years.(3) Each member who is 55 years old or older shall be examined once each year.(4) The director shall assign to each member a medical code classification as provided in Regulation .0204(b). Each member who has been assigned a Class B code, as described in Regulation .0204(b)(2), shall be examined once each year.(5) The director may determine that some members, even though they have been assigned a Class A code, have some special medical problem which requires an annual examination.(d) If a BPS supervisor feels that a medical problem is affecting a member's performance on the job, the supervisor may, as part of the complete evaluation of the member's performance, require that the member be given a medical examination in addition to the periodic examinations described in (c) of this Rule.(e) Members who are on sick leave or on leave without pay due to an illness for a period of more than 30 calendar days may be required, at the discretion of the chief, to be examined under the BPS Medical Services Program, and the examining physician shall determine whether the member is able to return to duty. Members who have had a major surgical operation may not return to duty until they have been cleared by the Medical Services Director. Members who have been on prolonged military leave or any other prolonged leave of absence may not return to duty until they have been cleared for duty by the Medical Services Director.14B N.C. Admin.
