Section 629.1 - Reimbursement for Jobs Opportunities and Basic Skills (JOBS) training program
(a) Reimbursement for JOBS training program activities and related supportive services must be claimed on schedules and in formats prescribed by the department and in accordance with department directions set forth in section 600.2(g) of this Title. Amounts subject to reimbursement pursuant to title IV-F of the Federal Social Security Act or which may be claimed under other programs for which there is federal participation as described in section 600.2(j) of this Title must be claimed in a manner that results in receipt by the State of the greatest amount of Federal financial participation available or, alternatively, must be claimed in a manner that does not increase the amount of State reimbursement to be paid above the amount that would be paid if the maximum amount of federal financial participation were received.
(b) Expenditures made by social services districts for JOBS training program activities and related supportive services are subject to reimbursement by the State in accordance with:
(1) the provisions of title IV-F of the Federal Social Security Act and section 153 of the Social Services Law when authorized pursuant to this Part;
(2) other provisions of such act and section 153 of the Social Services Law if such expenditures are not eligible for reimbursement pursuant to title IV-F of such act but are eligible for reimbursement under other provisions of such act; or
(3) the provisions of sections 131, 153 and 331 of the Social Services Law if such expenditures are not reimbursable pursuant to any provisions of the Social Security Act.

When Federal financial participation is available for the JOBS training program and related supportive services, Federal funds must be claimed in a manner that results in the maximum amount of Federal financial participation or must be claimed in accordance with department directions set forth in section 600.2(g) of this Title.

(c) Federal financial participation must be claimed for administrative and other expenditures made by social services districts which related to JOBS training program activities. Such claims will:
(1) be limited to 50 percent Federal financial participation with respect to costs for supportive services and for administrative expenditures in accordance with the provisions of section 153 (13) of the Social Services Law; and
(2) be limited in accordance with the provisions of section 153 (13) of the Social Services Law to 60 percent Federal financial participation with respect to expenditures which relate to JOBS training program activities, including but not limited to, expenditures for:
(i) full-time and part-time employees of a social services district or employees of an entity which has contracted with the district to work exclusively in any capacity on JOBS training program activities specified in section 629.3 of this Part;
(ii) full-time employees who work on JOBS training program activities less than full-time, for that portion of their time spent on providing JOBS training program services and recipient activities related to the JOBS training program; and
(iii) nonpersonal items including costs for space, utility costs, telephone costs, and the costs for materials and supplies associated solely with JOBS training program activities; and
(3) be subject to 50 percent Federal financial participation with respect to so much of such expenditures which related to JOBS training program activities including, but not limited to, expenditures for:
(i) JOBS training program planning and administration;
(ii) fair hearing activities described in Part 358 of this Title associated with issues of participants' eligibility for or participation in the JOBS training program;
(iii) data collection activities conducted by social services district employees not working exclusively on the JOBS training program;
(iv) nonpersonal items associated with social services district employees who do not work exclusively on the JOBS training program; and;
(v) overhead costs related to the JOBS training program.
(d) Any available Federal financial participation must be claimed for administrative expenses incurred in providing reasonable and necessary supportive services to enable participants to accept employment or participate in education, training and employment activities under the JOBS training program as described in Part 385 of this Title. State reimbursement for child day care assistance expenditures made pursuant to the provisions of section 131-a (6) of the Social Services Law may be claimed in accordance with the provisions of section 153 (14) of the Social Services Law.
(e) Amounts expended for administration of JOBS training program activities as described in Part 385 of this Title must be claimed in accordance with department directions set forth in section 600.2(g) of this Title. Such activities include, but are not limited to, expenditures for:
(1) the job search program for employable, job ready applicants for and recipients of Home Relief who are not residing with their dependent children under the age of 18;
(2) on-the-job training and employment assistance to recipients of Home Relief by private employers;
(3) a public work project for employable Home Relief recipients who are unable to secure employment in the regular economy; and
(4) the employment and training activities offered to Home Relief or Veteran Assistance recipients described in section 629.3 of this Part.
(f) In accordance with the provisions of section 153 (13) of the Social Services Law, and with the approval of the Director of the Budget, the department may distribute any additional Federal funds properly received or to be received and not otherwise expended for the JOBS training program pursuant to title 9-B of article 5 of the Social Services Law. The distribution of such funds will be made in accordance with department directions set forth in section 600.2(g) of this Title. Such directions will be prepared from time to time when the department determines that there are any such Federal funds not otherwise expended for the JOBS training program and will be devised in a manner that establishes a means of distribution that is consistent with the policies and purposes of the JOBS training program as set forth in section 331 of the Social Services Law.
