Section 22.2 - Motorcycles

Speed capability, vehicle profile and equipment of a motorcycle are the primary characteristics to be considered in determining whether a motorcycle is unsafe for operation on the public highways. A registration pursuant to section 410 of the Vehicle and Traffic Law will be issued for a motorcycle, other than a motorcycle-type vehicle which is designed and primarily used for a purpose other than for the transportation of persons or goods, only if such motorcycle:

(a) has the capability of attaining a speed of more than 40 miles per hour on level ground;

(b) has, if a two wheeled motorcycle, a seat or saddle height for the driver of at least 25 inches (63.5 centimeters) from the ground in its lowest position; and

(c) meets all equipment requirements of section 381 of the Vehicle and Traffic Law.
