Section 80-4.1 - Articles of wearing apparel

(a) All textile fabrics (except those with a nitro-cellulose fiber, finish or coating) shall be deemed highly flammable and dangerous when worn by individuals if such fabrics or any uncovered or exposed part of an article of wearing apparel exhibits rapid and intense burning when tested under the conditions and in the manner prescribed in Appendix F-1 of this Part (Commercial Standard 191-53, Flammability of Clothing Textiles, issued by the U. S. Department of Commerce).

(b) Notwithstanding subdivision (a) of this section, coated fabrics, except those with a nitro-cellulose coating, may be tested under the procedures in Appendix F-2 of this Part (Commercial Standard 192-53, General Purpose Vinyl Plastic Film, issued by the U. S. Department of Commerce). If such coated fabrics do not exhibit a rate of burning in excess of that specified in paragraph 3.11 of such commercial standard, they shall not be deemed to be so highly flammable as to be dangerous when worn by individuals.

(c) All film and textile fabrics with a nitro-cellulose fiber, finish or coating intended or sold for use in wearing apparel, and all film and textile fabrics which are contained in articles of wearing apparel, shall be deemed highly flammable and dangerous when worn by individuals if such film or such textile fabrics or any uncovered or exposed part of such articles of wearing apparel exhibit a rate of burning in excess of that specified in paragraph 3.11 of Appendix F-2 of this Part (Commercial Standard 192-53, General Purpose Vinyl Plastic Film, issued by the U. S. Department of Commerce).
