Up to the hour set for such sale, the commissioner will receive sealed bids for a coal lease upon any tract of land described in the posted notice. All sealed bids submitted will be opened at the hour mentioned in the notice and, if the tract is designated in the notice of sale as being offered for sealed bid, then the lease will be awarded to the highest and best sealed bid. If the tract is designated in the notice of sale as being offered for sale at public auction, then any sealed bid received will be considered as the first (1st) oral bid for the subject tract.
