Unless exempt pursuant to N.J.S.A. 45:15-16.3 2, a home builder selling house and lot packages offered as part of a common promotional plan, regardless of whether the lots are contiguous, is a "subdivider" as defined in 45:15-16.2 8, and therefore such offerings are subject to the Act and to this subchapter.
