Section 706.4017 - Administrative fines: Action by Authority1. The Authority will review the decision of a hearing officer and enter a final order affirming, modifying or setting aside the decision.2. If a respondent fails to appear at the time and place set for an administrative proceeding, the Authority may impose a fine for the violations alleged in the complaint.3. In determining the amount of a fine to be imposed pursuant to an administrative proceeding, the Authority may consider: (a) The seriousness of the violations alleged in the complaint which were demonstrated to have been committed by the respondent;(b) Any hazard to the health or safety of the public resulting from those violations;(c) Any economic benefit received by the respondent as a result of those violations;(d) Any mitigation or aggravation by the respondent of the effects of those violations;(e) The extent to which the respondent demonstrates his or her good faith;(f) Any previous history of violations by the respondent;(g) The amount necessary to deter future violations; and(h) Any other appropriate matter.Nev.
