Section 184-1-002 - DEFINITIONS

The following definitions apply.

002.01APPLICANT. Any person who makes an application.
002.02APPLICATION. A request for a credential or permit or for the amendment, correction, or issuance of a vital record that the Division is authorized by law to grant or deny, in whole or in part.
002.03BOARD. A publicly appointed body that performs public functions related to Division programs.
002.04CONTESTED CASE. Has the meaning given in 53 Nebraska Administrative Code (NAC) 4-001.02B.
002.05CREDENTIAL. A license, certificate, or registration that the Division is authorized by law to grant or deny.
002.06DAY. A calendar day unless otherwise specified.
002.07DECISIONMAKER. The Division employee who issues a preliminary order or decision on behalf of the Division that is the subject of a contested case.
002.08DIVISION. The Department of Health and Human Services, Division of Public Health or persons exercising authority delegated to them by the Division.
002.09EX PARTE COMMUNICATION. Has the meaning given in 53 NAC 4-001.02B.
002.10HEARING OFFICER. The Director of the Division or a person designated by the Director to conduct a hearing, contested case, or other proceeding.
002.11PARTY. Has the meaning given in 53 NAC 4-001.02B.
002.12PERMIT. A permission, authority, or approval of any kind that the Division is authorized by law to grant or deny.
002.13PETITION. Has the meaning given in 53 NAC 4-001.02B.
002.14PLEADING. A petition, answer, reply or response, notice, motion, stipulation, objection, discovery document, order, decision or other written document filed in a proceeding.
