Section 26.01.02.06 - Request for HearingA. A person, either directly or through a representative, may request a hearing by mailing or delivering a clear written request in accordance with the notification of the right to a hearing.B. The request shall state that the person desires a hearing in order to review a matter as provided under Department regulations or other applicable law, and should include a copy of the document or charge being appealed.C. The request shall include a brief statement of the factual and legal basis for the request, and other information required by law.D. The Department may require the statement to be made on a form if the person is notified of this requirement and is provided a copy of the form in the notice of the right to a hearing.E. A request for a hearing shall be considered filed on the earlier of: (1) The date the request is actually received in any office of the Department; or(2) Three days after the request has been postmarked by the United States Postal Service.Md.
