Section 185-110-36 - The Commission's Presiding Officer and His or Her Duties

One of the two attorney members of the Commission shall be the Chairperson of the Commission, as required by 22 M.R.S. Section152, paragraph one. The Clerk of the Commission shall assign one of the two attorney members of the Commission to be the presiding officer in any case or proceeding before the Commission. Except where these rules specifically state that the Chairperson of the Commission alone is authorized to make a ruling or decision, the other attorney member of the Commission may act as the Chairperson's designee and may act as the presiding officer of the Commission. The presiding officer may:

(A) Administer oaths and affirmations;
(B) Rule on the admissibility of evidence;
(C) Regulate the course of the hearing, set the time and place for continued hearings, and fix the time for filing of evidence, briefs, and other written submissions;
(D) Take other action authorized by statute or Commission rules.
