Section V-1309 - Rejection of Individual Bids or ProposalsA. General. This Subsection applies to rejections of individual bids or proposals in whole or in part. 1.Proposals (as used in this Section)-competitive responses solicited in accordance with R.S. 39:1595 and Chapter 26 of these regulations.B. Notice in Solicitation. Each solicitation issued by the state shall provide that any bid or proposal may be rejected in whole or in part when in the best interests of the state as provided in these regulations.C. Reasons for Rejection. As used in this Section, bid means any bid or proposal submitted in compliance with competitive sealed bidding requirements and submissions under Chapter 7 (Small Purchases) or competitive sealed proposals governed by R.S. 39:1595. Reasons for rejecting a bid or proposal include but are not limited to: 1. the person that submitted the bid or proposal is nonresponsible as determined under §1511 of these regulations;2. the bid or proposal is not responsive.; or3. the supply, service, or major repair items is unacceptable, that is, it fails to meet the specifications or permissible alternates or other acceptability criteria set forth in the invitation to bid or request for proposal.
