Section XV-465 - Transfer for Disposal and Manifests
A. The requirements of this Section and Appendices D and E of this Chapter are designed to: control transfers of low-level radioactive waste by any waste generator, waste collector, or waste processor licensee, as defined in LAC 33:XV.499.Appendix D, who ships low-level waste either directly or indirectly through a waste collector or waste processor to a licensed low-level radioactive waste disposal facility; establish a manifest tracking system; and supplement existing requirements concerning transfers and recordkeeping for those wastes.
B. Each shipment of radioactive waste designated for disposal at a licensed low-level radioactive waste disposal facility shall be accompanied by a shipment manifest in accordance with LAC 33:XV.499.Appendix D.
C. Each shipment manifest shall include a certification by the waste generator in accordance with LAC 33:XV.499.Appendix D.
D. Each person involved in the transfer of waste for disposal or in the disposal of waste, including the waste generator, waste collector, waste processor, and disposal facility operator, shall comply with the requirements specified in LAC 33:XV.499.Appendix D.
E. Any licensee shipping byproduct material as defined in LAC 33:XV102, byproduct material, 3, 4, and 5 intended for ultimate disposal at a licensed land disposal facility shall document the information required for the consignee and transfer this recorded manifest information to the intended consignee in accordance with the requirements specified in LAC 33:XV499, Appendix D.
F. Licensed material as defined in LAC 33:XY102. byproduct material, 3, 4, and 5 may be disposed of in accordance with LAC 33:XV. Chapter 13, even though it is not defined as low level radioactive waste. Therefore, any licensed byproduct material being disposed of or transferred for ultimate disposal at a facility licensed under LAC 33 :XV. Chapter 13 shall meet the requirements of Subsections A-E of this Section. A licensee may dispose of byproduct material, as defined in LAC 33:XV102, byproduct material, 3, 4, and 5, at a disposal facility authorized to dispose of such material in accordance with any federal or state solid or hazardous waste law, including the Solid Waste Disposal Act, as authorized under the Energy Policy Act of 2005.
