NECESSITY, FUNCTION, AND CONFORMITY: EO 2004-726, effective July 9, 2004, reorganized the Cabinet for Health and Family Services and placed the Department for Behavioral Health, Developmental and Intellectual Disabilities within the cabinet. KRS 210.440 and 210.450 authorize the Cabinet for Health and Family Services to establish regional behavioral health, developmental and intellectual disabilities boards to act as the authority for planning and administration of grants for all local programs relating to behavioral health, developmental and intellectual disabilities. This administrative regulation is to provide for recognition of regional behavioral health, developmental and intellectual disabilities boards as the local authority for implementing delegated responsibilities and to insure compliance with applicable policies issued by the cabinet.
Section 1. Grants. All grants for local programs in behavioral health, developmental and intellectual disabilities implemented under the auspices of the cabinet shall be directed to agencies recognized as regional behavioral health, developmental and intellectual disabilities boards by the Cabinet for Health and Family Services, Department for Behavioral Health, Developmental and Intellectual Disabilities. For purposes of implementing the delegated regional responsibilities of the Department for Behavioral Health, Developmental and Intellectual Disabilities, the regional behavioral health, developmental and intellectual disabilities boards shall become the local authority. Recognition as local authority shall be renewed annually provided the board is in compliance with applicable federal and state laws, and administrative regulations relating to behavioral health, developmental and intellectual disabilities boards.Section 2. Policies. All regional behavioral health, developmental and intellectual disabilities boards shall comply with the policies issued by the cabinet to insure compliance with applicable federal and state laws and regulations.
