Section 65-9-2 - Application
(a) To request approval of a trade or assumed name, one or more of the licensees associated with the optometric office at which the trade or assumed name will be used shall file a fully completed application with the secretary-treasurer on a form prescribed by the board.
(b) As part of the application, each applicant shall certify that the applicant:
(1) has personally made a diligent search and is unaware of any other person or entity using the trade or assumed name or a name so similar as to create a potential for confusion; and
(2) intends to actively engage in the practice of optometry under the trade or assumed name upon obtaining approval from the board.
(c) If any applicant desires to use the trade or assumed name at any practice location other than the one approved by the board, an additional application for approval shall be made to the board.
