Section 5-6-5 - Maximum reasonable annual quantity for storage of water for beneficial use in a reservoir

The maximum reasonable annual quantity of water that may be authorized for appropriation by the chief engineer for diversion and storage in a reservoir shall be limited to the lesser of either of the following:

(a) The potential annual runoff as determined pursuant to K.A.R. 5-6-4; or
(b) one of the following:
(1)
(A) A three-year supply of water to be rediverted for all authorized beneficial uses; and
(B) a three-year supply of water for indirect use; or
(2) if the total maximum annual quantity of water requested for storage in paragraphs (b)(1)(A) and (B) exceeds the reservoir capacity, the maximum annual quantity of water authorized to be diverted and stored in any one year shall not exceed the total of the following:
(A) The annual quantity of water rediverted for beneficial use;
(B) the reservoir capacity; and
(C) one year of indirect use from the reservoir.
