Rule 161-3.38 - Postinvestigation determination

(1) If a case file is sent to an administrative law judge for a probable cause or no probable cause determination, all parties will be notified of the outcome by written order. The agency will mail the order to all parties.

(2) Where the administrative law judge rejects the recommendation of agency staff, the reasons shall be stated in the order.
