Section 6-80-76 - Price, terms, and conditions(a) The price, terms, and conditions for access to poles, ducts, conduits, and rights-of-way must be just, reasonable, and nondiscriminatory.(b) A utility shall apportion the cost of providing space on a pole, duct, conduit, or right of way, other than a usable space, among the entities accessing the pole, duct, conduit, or right of way. The apportionment shall equal two thirds of the cost of providing space other than the usable space, and shall be allocated equally among all attaching entities.(c) A utility shall apportion the cost of providing usable space among all entities accessing the pole, duct, conduit, or right-of-way according to the percentage of usable space required by each entity.[Eff ] (Auth: HRS §§ 269-6, 269-34 to 43) (Imp: HRS §§ 269-34 to 43, 47 U.S.C. §224, 251, 252, 253 )
