Rule 6-A2108 - INITIAL REVIEW OF COMPLAINTS
2108.1

Upon the receipt of a complaint, OPC shall create a case file for the complaint, designate a number for the complaint, enter the case in a database, and preserve any body-worn camera evidence.

2108.2

OPC may request additional information from the complainant, and collect any evidence necessary for the initial review.

2108.3

The Executive Director shall screen each complaint and shall take one of the following actions:

(a) Dismiss the complaint, with the concurrence of one member of the Board;
(b) Refer the complaint to the United States Attorney for the District of Columbia for possible criminal prosecution;
(c) Attempt to conciliate the complaint;
(d) Refer the complaint to mediation;
(e) Refer the complaint to investigation;
(f) Refer the complaint to the MPD or DCHAPD for investigation because the complaint falls outside of the authority of OPC to review;
(g) Refer the subject police officer or officers to complete appropriate policy training by the MPD or the DCHAPD; or
(h) Refer the complaint to MPD or DCHAPD for rapid resolution.
