Any person, firm or corporation which believes that it has been wrongly denied certification as a DBE by the Department, or has been wrongly decertified, may file an appeal with the United States Department of Transportation in accordane with the procedures set forth in 49 CFR Part 23. The filing of such an appeal shall not automatically stay enforcement of the decision at issue. Rather, the person must seek a stay from the Commissioner or the United States Department of Transportation.
