The developer shall deposit with the Council a certified check payable to the Commonwealth of Massachusetts at the times and in the amounts stated below

(b) | greater than $1,000,000 but less than $25,000,00 | 5,000 |
(c) | greater than or equal to $25,000,000 | 10,000 |
(d) | hazardous waste landfill representing more than 20% of total project construction cost | 10,000 in addition to payment required under 990 CMR 16.00(1)(a), (b) or (c) |
In the event that the developer has submitted aNotice of Intent prior to July 15, 1983, the fee(s) payable at the time of submission of aNotice ofIntent shallbe paid by September 15, 1983. Failure to submit the fee(s) by September 15, 1983, shall result in automatic rescission of the determination that the proposed project is feasible and deserving of state assistance.
