Any person who is registered, qualified or otherwise carrying on business in the commonwealth at the time or who has a name under reservation may protest to the Division that the name assumed by a corporation is the same as or so similar that it is likely to be mistaken for the name of such person. The protest must be in writing and must be received by the Division within 90 days after the articles of organization or articles of amendment affecting a change in the name of a corporation have been filed with the Division.
